Terms and Conditions

Section 1: Scope of Terms and Conditions (AGB)

​

(1) These General Terms and Conditions (AGB) of the Practice for Energy and Environmental Medicine (Marco Brodbeck) form the contractual basis for all relationships between the Practice for Energy and Environmental Medicine (Marco Brodbeck) and its contractual partners. With each conclusion of a contract, the contractual partner accepts the complete inclusion and validity of these terms and conditions.

(2) Where the requirement for written form is mentioned below, this requirement can also be fulfilled by letters, fax messages, emails, or individualized website-based communications (especially orders through the online shop of the Practice for Energy and Environmental Medicine (Marco Brodbeck)).

​

(3) Changes or additions to the AGB of the Practice for Energy and Environmental Medicine (Marco Brodbeck) by the contractual partner will only become effective with the explicit written confirmation of the Practice for Energy and Environmental Medicine (Marco Brodbeck).

​

(4) The contractual partner expressly waives the applicability of any of its own general terms and conditions.

​

(5) General changes to the AGB of the Practice for Energy and Environmental Medicine (Marco Brodbeck) will be communicated to the contractual partner in writing or by other appropriate means (online) by the Practice for Energy and Environmental Medicine (Marco Brodbeck) and will come into effect within 30 days without written objection from the contractual partner.

​

(6) If any provision of the AGB of the Practice for Energy and Environmental Medicine (Marco Brodbeck) is found to be invalid, it will be replaced by the effective provision that comes closest to the economic purpose of the invalid provision. The validity of the remaining provisions will not be affected.

​

Section 2: Offer, Price, Conclusion of Contract, and Payment

​

(1) All offers from the Practice for Energy and Environmental Medicine (Marco Brodbeck), especially for goods, seminars, and coaching, are non-binding and are merely an invitation to submit an offer.

​

(2) The prices stated for services provided by the Practice for Energy and Environmental Medicine (Marco Brodbeck) do not include value-added tax (VAT) and shipping and packaging costs, unless otherwise stated. Price changes are reserved. VAT and shipping and packaging costs will be separately stated in the invoices and are to be borne by the contractual partner.

(3) The order of a service from the Practice for Energy and Environmental Medicine (Marco Brodbeck) by the contractual partner is considered a binding offer to the Practice for Energy and Environmental Medicine (Marco Brodbeck). A contract is concluded when the Practice for Energy and Environmental Medicine (Marco Brodbeck) declares the acceptance of the offer in writing.

(4) Subsequent changes and additions to a contract concluded with the Practice for Energy and Environmental Medicine (Marco Brodbeck) require written form.

​

(5) The prices for services provided by the Practice for Energy and Environmental Medicine (Marco Brodbeck) are due for payment immediately upon conclusion of the contract unless otherwise agreed. If invoices are not paid on time, the Practice for Energy and Environmental Medicine (Marco Brodbeck) reserves the right to claim statutory default interest of 5%. The costs for reminders (a flat rate of CHF 20 per reminder) and debt collection measures (according to expenses) can be invoiced to the overdue contractual partner.

(6) Payment by offsetting is expressly excluded.

​

(7) Specific additional general conditions for goods, seminars, and coaching that must be observed can be found in the following Sections 3 and 4.

​

Section 3: Goods

​

(1) Goods are to be ordered in writing.

​

(2) If goods are ordered from the Practice for Energy and Environmental Medicine (Marco Brodbeck), the benefits and risks pass to the contractual partner upon conclusion of the contract.

​

(3) Orders for goods cannot be canceled. Delivered goods will not be accepted for return.

​

(4) The delivery of goods is at the expense and risk of the contractual partner. The contractual partner bears the shipping and packaging costs as well as the transport risk.

​

(5) Delivery dates are only binding for the Practice for Energy and Environmental Medicine (Marco Brodbeck) if they have been confirmed in writing by the Practice for Energy and Environmental Medicine (Marco Brodbeck) upon acceptance of the order.

​

(6) Partial deliveries must be accepted by the contractual partner.

​

(7) The goods remain the property of the Practice for Energy and Environmental Medicine (Marco Brodbeck) until full payment. The Practice for Energy and Environmental Medicine (Marco Brodbeck) is authorized to obtain a corresponding entry in the retention of title register.

​

Section 4: Seminars, Coaching, and Programs

​

(1) Registrations for seminars, coaching, and programs must be made in writing.

​

(2) The number of participants is usually limited. Registrations will be considered in the order of receipt. Registration is binding only upon the receipt of the corresponding written acceptance declaration from the Practice for Energy and Environmental Medicine (Marco Brodbeck).

​

(3) The fees for seminars, coaching, and programs are to be paid in advance according to the invoice. Failure to pay on time will result in refusal of participation in the seminar, program, or coaching.

​

(4) Cancellation of a seminar or program does not release the registrant from the full payment of the seminar or program fees. However, the person canceling can propose a replacement participant who will attend in their place and pay the fees. The acceptance of this replacement participant can be rejected by the Practice for Energy and Environmental Medicine (Marco Brodbeck) if it would affect the quality of the seminar or program and negatively impact other participants.

​

(5) Cancellation of coaching, seminar, or program must be made in writing. Depending on the timing of the cancellation, coaching fees are due as follows:

  • 10 days before the start and later: 100% of the total amount

  • 20 days before the start: 80% of the total amount

  • 30 days before the start: 50% of the total amount

(6) If a customer is unable to participate in an ongoing seminar, program, or scheduled coaching due to important reasons, no (full or partial) participation fees will be refunded, nor will there be an entitlement to free repetition or other free participation. This also applies in cases where the customer is prevented from participating without their own fault, particularly due to force majeure.

(7) For important organizational reasons, the Practice for Energy and Environmental Medicine (Marco Brodbeck) reserves the right to reschedule or combine seminars or programs, change the location, and replace speakers. Only in the event of cancellation of a seminar or program will the paid participation fee be refunded; there will be no, not even partial, refund in the other mentioned changes.

​

(8) If a coach contracted by the Practice for Energy and Environmental Medicine (Marco Brodbeck) is personally prevented from providing coaching for important reasons, a replacement coach may be engaged for the provision of the service or the coaching may be rescheduled.

​

(9) Animals and the use of mobile phones may be prohibited in seminar rooms and during coaching sessions by the seminar leader or coach without stating reasons. Disruptive participants may be excluded from a seminar, and in such cases, no seminar costs will be refunded.

​

(10) In the absence of other agreements, travel, accommodation, meals, and insurance are the responsibility of the seminar, program, or coaching participants and are to be paid by them. Neither the Practice for Energy and Environmental Medicine (Marco Brodbeck) nor the seminar management, speakers, or coaching advisors can be held liable for theft, damage, or loss of personal belongings.

​

(11) The Practice for Energy and Environmental Medicine (Marco Brodbeck), seminar or program management, speakers, and coaching advisors do not assume, to the extent legally permissible, any responsibility for the consequences of counseling or other activities of the participants, even if these are based on statements or documents made at seminars or programs of the Practice for Energy and Environmental Medicine (Marco Brodbeck) or within the scope of coaching by the Practice for Energy and Environmental Medicine (Marco Brodbeck). The Practice for Energy and Environmental Medicine (Marco Brodbeck), seminar or program management, speakers, and coaching advisors also reject any liability, to the extent legally permissible, for actions, statements, and recommendations of other participants.

Section 5: Warranty and Liability

​

(1) The Practice for Energy and Environmental Medicine (Marco Brodbeck) excludes all liability (pre-contractual, contractual, and non-contractual liability) for its goods, seminars, programs, coaching, and other services, to the extent legally permissible. In particular, liability for third parties is fully disclaimed, to the extent legally permissible.

​

(2) The Practice for Energy and Environmental Medicine (Marco Brodbeck) warrants to the contractual partner that the goods delivered by it at the time of the transfer of risk are free from manufacturing and material defects that substantially impair or eliminate their usability. Insignificant deviations from guaranteed characteristics do not give rise to warranty rights. Any defect complaints must be made in writing within 10 days of receipt of the goods or discovery of the defect to the Practice for Energy and Environmental Medicine (Marco Brodbeck). In the case of goods that are timely objected to and are found to be defective, the Practice for Energy and Environmental Medicine (Marco Brodbeck) can, at its discretion, provide remediation, replacement, reduction, or withdrawal. The statutory warranty rights expire within one year of delivery, unless the buyer is not a consumer in the legal sense. For consumers, an extended limitation period of two years applies. Otherwise, the exclusion of liability in Section 1 above shall apply, in particular for consequential damages resulting from defects.

Section 6: Data Protection and Copyright

​

(1) The contractual partner expressly authorizes the Practice for Energy and Environmental Medicine (Marco Brodbeck) to process, store, and evaluate the data received in connection with the business relationship for its own use.

​

(2) All documents, data carriers, and other intellectual works of the Practice for Energy and Environmental Medicine (Marco Brodbeck) are protected by copyright. In the event of copyright infringement (especially through reproduction, dissemination, taking over of parts, or changes without written permission), a contractual penalty of CHF 2,000 is owed; additionally, the Practice for Energy and Environmental Medicine (Marco Brodbeck) claims compensation. For other intellectual property rights infringements, a contractual penalty of CHF 2,000 is also owed, and the Practice for Energy and Environmental Medicine (Marco Brodbeck) claims compensation.

​

Section 7: Applicable Law and Jurisdiction

​

(1) All legal relationships between the contractual partner and the Practice for Energy and Environmental Medicine (Marco Brodbeck) are subject to Swiss law, with the Vienna Sales Convention and other international agreements concerning the purchase of goods being excluded.

​

(2) The place of jurisdiction for all disputes arising from legal relationships is the registered office of the Practice for Energy and Environmental Medicine (Marco Brodbeck), Liestal (Switzerland); other mandatory places of jurisdiction remain reserved.
